Terms and Conditions of Purchase
- How a Contract is Formed.
No contract in respect of any products shall exist between you and Artika until your order has been accepted by Artika, as further explained below. If we do not accept your offer and funds have already been deducted from your account, these will be fully refunded.
To place an order, you will be required to follow the shopping process online and press the “PAY” button to submit the order and confirm your acceptance to these Terms and Conditions of Purchase.
After this, within 24 hours, you will receive an e-mail from Artika acknowledging that we have received your order (the “Order Confirmation”). Please note that this does not mean that your order has been accepted, as your order constitutes your offer to us to buy one or more products from us. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the product has been dispatched (the “Shipment Confirmation”).
The contract for the purchase of a product between us (“Contract”) will only be formed when we send you the Shipment Confirmation. The Contract will relate only to those products whose dispatch we have confirmed in the Shipment Confirmation. We will not be bound to supply any other products which may have been part of your order until the dispatch of such products has been confirmed in a separate Shipment Confirmation.
- Availability of Products.
All orders for products are subject to availability and in this regard, in the event of supply difficulties or because products are no longer in stock, we refund any monies that you might have paid and are reflected in your Order Confirmation.
- Refusal of Order.
We reserve the right to withdraw any products from the Site at any time and/or remove or edit any materials or content on the Site. Whilst we will make our best efforts to always process all the orders, there may be exceptional circumstances which mean that we may need to refuse to process an order after we have sent you an Order Confirmation, which we reserve the right to do at any time, at our sole discretion. We will not be liable to you or any other third party by reason of our withdrawing any product from the Site, whether it has been sold or not, removing or editing any materials or contents on the Site or for refusing to process or accept an order after we have sent you the Order Confirmation.
- Risk of Loss.
All purchases of products from our Site are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.
- Title.
Ownership of the product(s) will only pass to you when we receive full payment of all sums due in respect of the products, including delivery charges, or upon delivery, whichever event occurs later in time.
- Pricing.
The price of the products shall be the one quoted from time to time on our Site, except where there is an error. Despite our best efforts, a small number of the items in our catalog may be mispriced. If we discover an error in the price of any product(s) you have ordered, we will inform you as soon as possible and give you the option of reconfirming the order at the correct price or cancelling it. If we are unable to contact you, the order will be treated as cancelled and if you have already paid for the product(s) you will receive a full refund.
- Sales Tax.
Pursuant to the prevailing rules and regulations in force, all purchases done through the Site are subject to Sales Tax, according to the shipping address of your order.
- Accepted Payment Methods.
The following are acceptable method of payment on the Site:
- PayPal.
- Shipping.
Shipping Costs:
Pricing on the Site’s products does not include shipping costs.
Shipping costs must be borne by the customer and shall be added to final price of the customer’s order, as a separate line item, to be reviewed and accepted before placing the order by pressing the “PAY” button on the customer’s screen.
Customer will be responsible for selecting and accepting the final order price, including the shipping costs, when placing an order on Artika’s Site.
Shipping costs shall be determined subject to speed/type of shipping selected by the customer during the checkout process and the geographical location inputted by Customer for delivery.
Shipping Process:
Subject to availability, and unless there are any exceptional circumstances, we will endeavor to fulfill your order for product(s) listed in the Order Confirmation by the delivery date set out in the Order Confirmation.
Generally, purchase orders for items in stock products are shipped to the delivery address indicated by the customer during the checkout process, within 15 business.
- Returns.
Artika accepts returns that are requested by the customer within 30 days after delivery of the order and that are the result of Artika error. Artika is not otherwise required to accept any return or exchange or to grant any refund (collectively referenced herein as a “return”). Artika may accept a return of a customer’s order even if Artika is not required to accept a return, including if the product is damaged when delivered to customer or the customer’s order was incorrect, and we may credit your account for the return without your actual return of the damaged or incorrect item. Artika reserves the right to reject any returns not the result of our sole error, and no return is authorized without the customer first obtaining a return authorization number by contacting Artika Customer Service at customerserviceusa@artikabooks.com .
Within a few business days of your request for a return or as soon after as is reasonably practicable, Artika’ Customer Service will make a decision as to whether to authorize the return and provide authorized returns with a Artika return label or other mailing instructions. Artika only accepts returns that are authorized and shipped to Artika using an Artika return label or pursuant to Artika’ return instructions, and you must get prior authorization from Artika before shipping any return to Artika. If you ship items to Artika without Artika authorizing the return by advance written consent, you agree we may dispose of the unauthorized return however we deem appropriate, and you will not get a refund or exchange for such item(s) you return without advance authorization from Artika.
We reserve the right to charge a restocking fee, handling fee, and return shipping fee for any return, refund, or exchange that is not the result of our error. Delivery fees, taxes, and handling fees previously paid by you are all non-refundable.
Risk of loss of all orders passes to you upon our delivery to the shipping carrier. If you request a refund as a result of a shipping delay and we decide in our sole discretion to process such refund, we will process such refund only if such order does not arrive at your shipping address within 20 days of your order for US domestic orders and within 45 days for international orders.
We do not accept returns, honor exchanges, or provide refunds for:
- Requests that are made after the 30-day return/refund/exchange window;
- Items that are no longer desired by the customer after purchase; or
- Any customer that violates these Terms of Purchase or any other applicable terms or conditions on the Site.
Further, we are unable to accommodate purchase cancellations and address changes after an item has been shipped.
We reserve the right to refuse to accept a return, issue a refund, or permit an exchange, and to otherwise deny any of the abovae remedies in our sole discretion at any time.
